Terms and Conditions
1. GENERALLY
These terms and conditions shall, unless otherwise agreed in writing, apply to all transactions between Danish Fiskeauktioner A/S (DFA) and the seller.
The conditions shall apply in relation to:
- Existing agreements
- Day-to-day deliveries
- Verbal agreements
Written agreements will enter into force when all parties have signed the agreement. Verbal agreements will enter into force at inception and are valid regardless of any subsequent transmitted order confirmation.

2. PRICE AND COSTS
All prices are in Danish kroner excl. VAT unless otherwise agreed in writing.
Costs for services provided by DFA are settled in accordance with applicable expenses sheet. The prices in force are available on the DFA website, www.dfa.as.
3. BASIS FOR PRICE FORMATION AND SETTLEMENT TERMS
The prices of the individual deliveries of fish and shellfish are determined in accordance with the price of sales via DFA's online auction system.
In accordance with current industry standard it agreed to use the "reverse charge" principle, unless otherwise agreed in writing, and DFA will as such issue an invoice with all purchase.
Seller shall immediately following receipt of the reverse charge invoice inform DFA of any possible discrepancy.
The seller is obligated to inform DFA if there are changes in their VAT registration etc.. If the seller receives an invoice that is not in accordance with the facts, then the seller is obligated to inform DFA, so that DFA can correct the error.
DFA reserves the right to, at regular intervals, check on skat.dk if the reported information is correct.
4. TRACEABILITY
EU Control Regulation requires certain traceability information to follow the fish all the way from the vessel to the fishmonger. This means that the seller is obligated to disclose evidence of traceability to DFA.
If the seller cannot document the mandatory traceability details, then DFA is entitled to reject the goods / consignment.
5. BREACH AND DISPUTES
In case of breach of these Terms and Conditions then commen danish law applies, including the right to cancel the agreement and to claim damages for any loss occured.
All disputes must be settled by Danish law at the Copenhagen City Court, although the agreement should be tried at af the Maritime and Commercial Court in Copenhagen if the circumstances requires this..
